User Agreement
1. General Provisions
PT. THE SMART RESTAURANTS (hereafter referred to as “we,” “us,” or “our”) is committed to protecting the privacy of personal data of our customers, identifiable individuals who visit our website (the “Website”) and use our services (the “Services”). Amendments to this privacy policy will be posted on the Website and/or Services, and will become effective immediately upon publication. By continuing to use the Services following any amendments, you signify your acceptance of these changes.
2. Consent to Data Collection and Use
By joining us as a user of our Services, you provide personal information necessary for the activation of your account, for the delivery of Services, communication regarding your account status, and for other purposes outlined in this Privacy Policy. Your name, social media links, phone number, email address, and other details may be required for initial access to the Services or during their use. You will also be asked to create a personal password to secure your account. By voluntarily providing personal information to us, you agree to the collection, use, and disclosure of that information as described in this policy. From time to time, we may request confirmation of your consent to the collection, use, or disclosure of your personal data in specific circumstances.
We may use your personal data for the following purposes:
To provide and improve the quality of the Services and Website.
To provide you with relevant information to enhance your use of the Services.
To create, manage, and control your account, and to verify your access rights to the Services.

3. Marketing and Advertising Communications
3.1 Marketing and advertising communications will only be sent with the subscribers prior consent, which must be expressed through an action clearly identifying the subscriber`s intent to receive communications.
3.2 Subscriber identification is carried out by sending a special access code via SMS to the phone number provided by the subscriber. The subscriber then enters this code on the Website’s identification form.
3.3 When authorizing via a phone call, the user clicks on a phone link, triggering a confirmation call. This call is free, lasts one second, and automatically disconnects. To access the internet, the user must click the "Log in to the Internet" button.
3.4 The process of subscriber identification through access codes serves as a form of digital signature, confirming that the phone number belongs to the person agreeing to this User Agreement. Internet access via guest Wi-Fi is allowed only after the subscriber is identified.
3.5 The subscriber agrees to receive communications by ticking the box in the authorization form, stating, "I consent to receive communications in accordance with the User Agreement." Without consent, the subscriber must cease using the Website immediately.
3.6 By ticking the consent box, the subscriber fully agrees with all terms of this User Agreement, including consent to receive marketing communications, confirms the accuracy of the data provided, and consents to their lawful transmission.
3.7 Communications may be sent via SMS or email for the following purposes: obtaining feedback, informing the subscriber of products/services, notifying of promotions, discounts, or events, and general newsletters.
3.8 Consent to receive communications is granted to both the operator of the mailing and the dining establishment where the subscriber requests internet access via the public Wi-Fi network.
3.9 Subscriber consent to receive communications is valid indefinitely. However, the subscriber may revoke this consent or modify the terms of receipt at any time.
4. Your Rights to Your Information
You have the right to access and edit your information at any time via the web interface provided within the Services.
5. Disclosure of Information
We will only disclose your personal data to third parties following your instructions or when necessary to provide you with a specific service, or in compliance with applicable privacy laws. Generally, we do not sell, lease, or distribute your personal data without prior consent unless otherwise stated in this privacy policy.
Public information, such as your name, surname, and social media links that are accessible via external means, can be shared with third parties without your consent.
6. Aggregate Data
We may use your personal data to create aggregated data for internal use or sharing with selected parties. "Aggregate data" refers to data stripped of unique identifiers for identifying customers or end-users and has been altered or combined to provide summarized anonymous information. Your identity and personal data will remain anonymous within these aggregated datasets.

We use "cookies" and "log files" to track user information. Cookies are small data files transmitted by a web server through your browser and stored on your device. We use cookies to track which web pages visitors view, count clicks, monitor traffic, and measure service settings popularity.

9. Security
We strive to prevent unauthorized access to your personal data. However, no data transmission via the internet or mobile devices can guarantee 100% security. We will continue to improve our security systems as new technologies become available.
Please avoid sharing your passwords. We do not store your social media logins and passwords, and in the case of loss or forgetfulness, you must recover them through the social media service itself. All social media authorizations occur through services provided by the social media platforms, and we do not transfer your logins and passwords during authorization.
